Without a union contract the EI handbook and firing
“at will” is in force.
With a union contract you can only be fired “with
cause”.
The following is from an actual contract:
In the event an employee’s conduct is such that dismissal is indicated, the employee shall first be suspended for a period of not more than 3 work days, and during this period of suspension the company will notify the employee and the union steward in writing as to the decision of the disciplinary action.
When an employee has been suspended, such employee will be given an opportunity of privately interviewing with a union steward, before such employee is required to leave the Company premises.
Should an employee be dismissed and it is later established that such dismissal was unfair or not in accordance with this agreement (the union contract) the employee shall be promptly returned to former status in all respects.
The Union will be advised in writing of any and all disciplinary action taken against an employee and the reasons for discipline.
